These Terms of Use (“Terms”) were updated on 2021-05-20. 

By accessing a Yateland service, downloading a Yateland application, or continuing to use the service, you should read this Agreement carefully in order to understand the terms and conditions that govern your (or Users’) use of the Services.

1. Dinosaur Math, Dinosaur Chinese, Dinosaur Coding 2 are physical subscription products delivered monthly on a monthly or annual auto-renewing subscription.

2. Dinosaur Chinese is a digital subscription product that gives customers access to the Dinosaur Chinese app. This subscription is available on a monthly or annual auto-renewing subscription.
3. Dinosaur Math is a digital subscription product that gives customers access to the Dinosaur Math app. This subscription is available on a monthly or annual auto-renewing subscription.
4.  Dinosaur Coding 2 is a digital subscription product that gives customers access to the Dinosaur Coding 2 app. This subscription is available on a monthly or annual auto-renewing subscription.

5. The following sites are covered by these Terms: Yateland.com, Yateland.cn.
6. The apps publish by Yateland on the Apple App Store, Google Play are covered by these Terms.

Yateland provides various related games, applications, or services (collectively the “Service”) to you, the user, subject to your compliance with these Terms of Service, as well as any other written agreement between us and you. These Terms of Service govern your and your children’s use of any online service location(e.g., website or mobile app) that posts a link to these Terms of Use (including both mobile and online versions). These Terms of Service apply regardless of how you access or use the Service, whether via personal computers, mobile devices or otherwise unless additional or different terms or written agreements are agreed to between us and you.

Yateland’s collection, use and disclosure, if any, of information

collected from you or a child authorized by you is detailed in our Privacy Policy.

a) Subject to the terms of this Agreement and your compliance with these terms, we grant you a non-exclusive, non-transferable, limited license to use the Services and associated software (collectively, the “Software”) for the term of the Agreement in your country of residence, on any compatible mobile device (“Devices”) that you own or control and solely as permitted by the applicable platform usage rules or terms of use (if any) (collectively, the “Usage Rules”). Any Yateland Software that updates, supplements or replaces the original Software is governed by this Agreement unless separate license terms accompany such update, supplement or replacement, in which case such separate terms will govern in the event of a conflict with this Agreement or as otherwise provided in such separate terms.

b) The preceding states the entirety of your rights with respect to the Software, and we reserve all rights in and to the Software not expressly granted to you in this Agreement. Without limiting the foregoing, you will not do, or authorize or permit any third party to do, any of the following: (i) distribute, copy, license, rent, or sell the Software (except as expressly permitted by this license or the Usage Rules); (ii) use the Software for any purpose other than your own personal, noncommercial use; (iii) reverse engineer, decompile, disassemble, or attempt to discover the source code for the Software; (iv) modify, alter, or create any derivative works of the Software; (v) remove, alter, or obscure any copyright, trademark, or other proprietary rights notice on or in the Software; (vi) use the Software for purposes for which it is not designed, or (vii) use the Software on any device that you do not own or control.

c) The Software is the property of Yateland and its licensors and is protected by copyright and other intellectual property laws and treaties. We and our licensors own all right, titles, and interests in and to the Software, including all copyright and other intellectual property rights in the Software.

The Service is an online system that may allow parent-authorized purchases funded by a credit card or other payment method from participating merchants using the Service. By using the Service, you acknowledge and accept our Privacy Policy and consent to the collection and use of your data in accordance with the Privacy Policy. To the extent that Yateland establishes aspects of the Service are only available to those users opting for additional paid licenses and you elect to use such paid aspects of the Service, you agree to the pricing, payment, and billing policies applicable to such fees and charges. The purchase of any paid license is final and shall under no circumstances be refundable, transferable, or exchangeable including, without limitation, upon the termination of your use of the service for any reason or no reason, termination of this agreement, and/or the discontinuation of the service.

By accessing and using the Services using a Device, or by using certain mobile features of Services, such as playing games, or otherwise engaging with the Services, you may incur fees from your mobile carrier. You are solely responsible for the payment of such fees.

a) Monthly Subscriptions
You can cancel a monthly subscription at any point after you’ve been billed for the first time. Your subscription will expire after the last billing date.  If you do not want your subscription to renew,  please cancel the subscription the day before your billing date.

b) Annual Subscriptions
Auto-renewing annual subscriptions (paid every 12 months) can be turned “off” at any time. We’ll cancel the next automatic renewal of the subscription and your subscription will expire after the pre-paid term. Auto-renewing subscriptions cannot be canceled midterm.

Yateland reserves the right to change or modify this Agreement at any time and for any reason at Yateland’s sole discretion. If Yateland makes changes to this Agreement, we will provide notice of such changes, such as by providing notice through the Services, or by updating the “Last Updated” date at the top of this Agreement. Your continued use of the Services will confirm your acceptance of the revised Agreement.  We encourage you to review the Agreement whenever you access the Services to ensure that you understand the terms and conditions that apply to your use of the Services. If you do not agree to any amended Agreement, you must stop using the Services.

To the maximum extent permitted by law, Yateland will not provide any warranty to users, express or implied, including but not limited to merchantability, applicability, reliability, accuracy, completeness, virus-free and error-free, any implied warranty and liability.

In addition, to the maximum extent permitted by applicable law, We do not guarantee that the products and services we provide will meet the requirements of customers, nor the service will not be interrupted. Moreover, no guarantee is made for the timeliness, security, occurrence of errors, and the accuracy, timeliness, and smooth transmission of information of products and services.

The Service (excluding any linked websites) is governed by the laws of the United States of America. You shall comply with all applicable laws, statutes, ordinances, and regulations regarding your use of the Website and Service. Although the Service may be accessible worldwide, we make no representation that materials on the Service are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access the Service from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

Nothing contained in these Terms of Use is in derogation of our right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Service or information provided to or gathered by Yateland with respect to such use. Any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof. To the extent permitted by law, Yateland has the right to interpret the terms of this agreement in the future.
